Uhhh @ Apple

I recently sent in my ipod for repairs through Apple's online service, i spent some time making sure my sexy machinery's condition was treatable, for free anyways. As i swept over the terms and conditions of repair, finding under what circumstances i'm not covered, i came under this particular tidbit:

Quote:
Apple reserves the right to refuse service on products that have serial numbers altered, defaced or removed or that are damaged due to accident, abuse, neglect, misuse (including faulty installation, repair, or maintenance by anyone other than Apple or an Apple Authorized Service Provider), unauthorized modification, extreme environment (including extreme temperature or humidity), extreme physical or electrical stress or interference, fluctuation or surges of electrical power, lightning, static electricity, fire, acts of God or other external causes.

true story

(its under point 3)

Hey, if they didn't put that in there, somebody would've tried to pull that off as an excuse, it's good they cover all their bases. Still funny though.

Wow.

So basically, unexplained accidents? They're definitely covering tracks here.

Most legal explanations of this nature have a statement for Acts of God. It's quite common.

It's true. You will also see that phrase in contracts that you sign for rental cars, for example. Of course, if they wanted to be really cool and legal, they would say that they aren't responsible for factum dei. But you can't have everything.

but how do they judge as to wheather it is an act of god or not? or do they just use the clause in event that they just didn't want to replace it for you?
