The problem I see with retiring the joker... Plotly-speaking...
Joker avoided capture so many times (one person on IMDB said he seemed almost 'too invincible')... Then when he DOES get captured, he has a scheme set up to allow his escape (granted I don't know exactly what that scheme was because our showing of the movie cut off just moments before that scene)...
Then the film basically ends with him getting arrested again (presumably)... And we're to expect that, after all that, he's not going to be able to find a way out again?
I think Nolan and his crew have quite a predicament on their hands...
P.S.: In the film's first four days of release, it's already surpassed the previous record FIVE day gross, and is only ~$650,000 short of the SIX day record gross...

Not really spoilers, but could lead people to draw conclusions:
Things aren't really any different in the comics. It is stated that the Joker, somehow, has the ability to pretty much come and go as he wants from Arkham. Any time he is captured, he can escape at any moment. He says something like "I only stay here to rest."
There are times when he breaks out, does things, then comes back. This doesn't mean that the Joker is in every single Batman comic, though, so not being in the last movie isn't a big deal. They can just say something about how he's currently locked up in Arkham, and the audience can assume that he hasn't broken out yet.
The Joker's final words to Batman "We're destined to do this for all time" says to be that Nolan wasn't completely done with the Joker, and he would have had at least a substantial cameo in the third one, but alas. I don't think he'll be resurrected, just mentioned.

Man, the third's villians have a tough act to follow. What if they used the Mad Hatter and the Riddler? I would pay to see Johnny Depp as The Riddler, five times, and maybe Christopher Walken as the mad hatter.  Maybe it would win them an Oscar for once.

Very possible. I know he expressed interest in being the Joker before Heath Ledger got the role.
