Without OpenGL they can't program for the GCN. Creating a new API will automaticly make it property of MS because part of the code HAS to be the same as OpenGL inorder to work.

Quoting somebody from TeamXbox:

MS asserted their intellectual property rights over some graphics programming code for OpenGL (vertex and fragment extensions, codeheads). This started some huge threads in a lot of places, including at least 2 on teamxbox. Incidentally, MS purchased these rights from SGI, it didn't develop them.

Some Xboxers have got the idea in their heads that this will give MS all kinds of money from Nintendo, Linux developers, or whomever else.

Please note that MS is only asserting reciprocal R&D rights on this. In other words, MS wants other companies to share any intellectual property THEY create for OpenGL in return for using Microsoft's.

Get it? NO MONEY INVOLVED.

So Nintendo owes...no money.
