Without OpenGL they can't program for the GCN. Creating a new API will automaticly make it property of MS because part of the code HAS to be the same as OpenGL inorder to work.

I saw this at another forum. I don't know much about this stuff. So, I'll just say that it doesn't sound true. I mean, being a big news i would already have apeared in IGN, Gamespot and such. My two cents. Can anyone lend me a fiver?

That lawsuit will never hold up in court. So don't get too excited. Macromedia and Adobe bitch and sue over rights constantly, get used to it. It's such BS, the lawyers really need something to do.
