http://www.cnn.com/2003/TECH/internet/07/19/downloading.music.ap/index.html

Some key points:

The music industry has won at least 871 federal subpoenas against computer users suspected of illegally sharing music files on the Internet, with roughly 75 new subpoenas being approved each day

Subpoenas reviewed by The Associated Press show the industry compelling some of the largest Internet providers, such as Verizon Communications Inc. and Comcast Cable Communications Inc., and some universities to identify names and mailing addresses for users on their networks known online by nicknames such as "fox3j," "soccerdog33," "clover77" or "indepunk74."

U.S. copyright laws allow for damages of $750 to $150,000 for each song offered illegally on a person's computer

In some cases, subpoenas cite as few as five songs as "representative recordings" of music files available for downloading from these users.

There was some evidence the threat of an expensive lawsuit was discouraging online music sharing. Nielsen NetRatings, which monitors Internet usage, earlier this week reported a decline for traffic on the Kazaa network of one million users, with similarly large drops across other services.

A new version of "Kazaa Lite," free software that provides access to the service operated by Sharman Networks Ltd., can prevent anyone from listing all music files on an individual's machine and purports to block scans from Internet addresses believed to be associated with the RIAA.

Yeah, we're fighting back! Down with the system!

But couldn't they just take them out of the shared folder to begin with?

The only sad part is how many people really don't know that it's illegal. How many people wanted music and had a friend set it up for them, and they just download songs not knowing? I mean, $750 a song? Yikes.

Now for the people who know it's illegal and don't care, it'll be fun to watch their faces on court TV.

it'll be interesting to see how many they actually win. there are all sorts of ifs and buts. and i read somewhere the court system is getting tired of a lot of the RIAA's silly lawsuits and actually has ruled against them many times.

i mean if the court wants to, they can find loop holes and things that may make all this not even worth it for the RIAA.

this is no where near the end of it. IMO the RIAA is digging themselves more and more into a hole which one day even they might not be able to climb out of.

you cant go around sueing the people you want to buy your stuff. instead of finding a new way, the RIAA is trying to keep the old ways.

i can actually see a new recording instustry pop up at some point and challenging the RIAA, with more music artists joining them. (dunno how to word that exactly how im thinking).

time goes by, things and ways of life change. you cant cling onto the old ways. instead of using this to the RIAA's advantage, they fight it.

This is because the RIAA is made up of a bunch of criminals. They're happy to sit back and lie about the cost of a CD. They're happy to lock CD prices while people download music. The RIAA is a perfect example of corporate business crying poor when they're still rolling in cash after another slumping CD year.

Blame the internet? Blames yourselves, RIAA.

not exactly. but it would prolly frustrate them even more if the program gave no user names. therefor they couldnt look up ppl. and wouldnt list what everyone has.

there will always be a way to grab your IP address tho. for that is how the program works. they need ip addresses

and even if the program doesnt show them. ppl can still find them. Download a song or send it to someone. check net stats and that ip address would be listed as your connected to it.

so there would be ways. just a matter of making it more difficult for them.

Now im not sure, but IF someone made one with a central server located in a country that wouldnt cooperate with RIAA, and when you download a song you connect to it first therefor it could hide your IP address ..... maybe

The RIAA has every right to want to end music piracy. But putting someone in jail for downloading a song isn't the way to go. But it doesn't have to be. I garauntee you no one here has the balls to download a song after they get a supeona in the mail.

The RIAA can send them out, sue the biggest violaters, and drop the charges on the rest. It's like speeding when a cop is driving behind you, you just don't do it. Send any person a supeona and they will stop downloading songs immediatly.

And no, I don't download songs anymore. Never was a big fan of it, never will be. I've used iTunes for 3 songs, the rest I just buy the CD.

Actually, it tend to be those who don't do the crime that support the RIAA. Mac users are not as big into piracy as PC users, period. While it's still there, many in the Mac community like Apple and would rather pay for their software. On top of that, the Mac users have been enjoying the iTunes store, which is great.

Downloading music is not worth the effort. Many Mac users would agree with me. But generally, anyone who is not a fan of pirating will support the RIAA.

its not. it may block ip's from its program.

however if someone downloads a song from you. Your IP address will appear in the net stats. Theres no way around it. you are connected to the person you are sharing music with. (unless it goes thro a central server)

I never said I supported the RIAA. I never said I didn't either. I download a lot of music that I don't own. I think the solution needs to come halfway between paying and downloading so that everyone is happy. Some companies are already practicing this and having great success, aka, iTunes store (I'm going to promote Apple any chance I have :D).

and they are making itunes for PC anyway.

as far as i understood it yes. they said something about it in PC World magazine, that apple will be doing that along with the apple software for the ipod.

so i wont have to use music match for my little ipod no more. WEEEE! :)

I know that Limewire is also compatible for Mac, but is Kazaa?

only if they make a kazaa version for mac. but mac has its own programs

reason limewire works in both is because its Java. java creates its own vitual os or something and runs on that. which also makes it slower, and i hate programing in java (that has nothing to do with it but i do really hate java)

Did Apple announce that?

There was never a huge announcement, because, why the hell would anyone following Apple give a damn? But it has been brought up periodically.

It started not long after iTunes 4 was released. It's a way for Apple to get the music store to the PC world as well. It's doing extremely well on Mac, there are many more PC users out there, and the music industry likes it, which in turn probably means more music and more exclusives for Apple.

The only thing in question is just how much will be supported on PC. Music sharing will be gone for sure, since it requires Rendezvous. Burning will likely work, but who knows about compatability. The first few iTunes releases didn't support many 3rd party CD-RWs. But the rest should work just fine, but that may or may not be a problem.

On the one hand, Apple may release it so PC users can understand what they're missing. On the other hand, it's less incentive to buy a Mac. So for all we know, Apple may take out some features, but that doesn't seem like Apple.

What's more likely is that iTunes for PC will not be free. Apple has charged for iMovie upgrades in the past, and currently charges for iDVD upgrades, but they come free with a new computer (and iMovie for OS X has always been free). Apple is also charging $29 for iChat AV, but it comes free with Panther. It wouldn't be surprising if Apple included iTunes with iPod purchases, but charged for PC users to buy it. Developing software for Windows costs money, more money than for Mac. It would be no surprise if iTunes was not free software. But on the other hand, good luck selling software to people who not only download their music, but probably everything else on thier computer.

GameMaster
07-23-2003, 03:38 PM
My upgrade to iMovie 3 was free. And the iTunes software price is probably added into the final price of the iPod so people are already paying for it when they buy their iPods. We get free iTunes upgrades but perhaps Window versions will cost?

well if they could find them. they'd like to be going after the big 'sharers'

They cant find the people that are just downloading a song. because how are they supposed to know if you are connected to someone else?

What they are doing is searching for copyrighted material in the search, and writing down all the usernames that pop up in the list, then they are clicking on each users and seeing what else they have that they are sharing.

Which raises a few questions. i dont think they're actually downloading a file from each person. So if they take someone to court, what if that person says he never let anyone take songs from him? what if he says he cancels each download ppl try and do from him? They have to prove he's actually giving stuff out. not that he just has files in his share folder.
The other question is im sure many of you have at least once ran into a file that said it was a certain thing. but really they just lied and its something totally worthless. what if they nab a person and take him to court and all he has is fake files. nothing real?

Then the ultimate question. or kinda wish thing..... If the RIAA is using kazaa or grokster or one of these types of programs.... Wouldnt it be just funny if they got some viruses from it? lol

I feel quite safe using the new version of Kazaa lite, with its disableing file sharing options, and its options to block other users from looking at everything you have.

They cant find the people that are just downloading a song. because how are they supposed to know if you are connected to someone else?

Well, they can actually. If the RIAA sets up their own server, and you attempt to download from them.

yea i mentioned that earlier in this topic. if they set up a trap and wait for you to download from them then grab your name and ip.

but then they would be sharing illegal files. lol :p

Well, yes and no. They have put out corrupt files in the past that are the same size as the real thing, but only play a small portion of the song before turning to junk. The trick there was to make it harder for people to get a good file, and then they get sick of it and just get the CD.

So they could use those.

this is true, However then that fuzzy line starts to come in to play again.

do they wait for you to download the full thing? or nab your name when you start the DL? otherwise you could listen before you finish downloading and decide.

Then they've basically given you a defence to use. one could say they didnt download a copyrighted song. they downloaded a file that plays a section and stops. kinda like a demo. never downloaded the real thing from them.

there is so many ifs and buts. will be interesting if some of these goto court.

Would you guys think I was a selfish pig if I downloaded songs and then relocated them?

no, i dont notice, they're all on the same network bro. it just so happens kazaa is the most popular.

theres a @fileshare and a @grokster

and i do believe kazaalite still uses @kazaa, no?

Oh, BTW, jason, you feeling safe with your new version. but who says they are using the newest version when they look? nothing is forcing everyone to upgrade. therefor wouldnt it be the same for them even if you are using a new version?

Um...I wouldnt think so...because Kazaa lite now has those options to block IP's and stop anyone from seeing your shared files and stuff like that...it wouldnt really matter what version other people are using...I have a feeling that not exactly what you mean though.

well block ip's is pointless. they can always find your ip no matter what the program does.

but just not sure exactly how the block songs is going to work. with ppl on older versions. have to read a little on it.
